Welcome to Friend Aura. These Terms of Service govern your use of our app. By using Friend Aura, you agree to these terms.

1. Acceptance of Terms

By downloading, installing, or using Friend Aura (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Friend Aura (the "Company," "we," "us," or "our") regarding your use of the App.

2. Description of Service

Friend Aura is a private iOS application that allows users to:

• Create and manage entries for personal connections
• Rate and track experiences using an "Aura Score" system
• Add notes, emojis, and other personal information to entries
• Secure their data with PIN or biometric locks
• Optionally sync data across devices via iCloud
• Customize the app's appearance with themes
• Purchase boosts and subscriptions for enhanced features

The App is designed for personal, private use and stores all user data locally on the user's device.

3. Eligibility

You must be at least 17 years old to use Friend Aura. By using the App, you represent and warrant that:

• You are at least 17 years of age
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations

If you are under 17, you may not use the App.

4. User Responsibilities

4.1 Acceptable Use

You agree to use Friend Aura only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Circumvent or bypass any security features or restrictions
• Use the App in a manner that could damage, disable, or impair the App
• Upload or transmit viruses, malware, or malicious code
• Violate any applicable laws, regulations, or third-party rights
• Share or distribute your purchased content (boosts, subscriptions) with others

4.2 Your Content

You are solely responsible for all content you create, store, or manage within the App, including:

• All entries, notes, scores, and personal information
• Any photos or media you add to the App
• Ensuring your content does not violate any laws or third-party rights

Because all data is stored locally on your device, we have no access to, control over, or responsibility for your content.

4.3 Data Security

While we've built Friend Aura with privacy and security in mind, you are responsible for:

• Keeping your device secure (PIN, Face ID, etc.)
• Managing your iCloud account security if you enable sync
• Backing up your data if desired
• Understanding that local device storage can be lost if your device is damaged, lost, or reset

5. Purchases and Subscriptions

5.1 In-App Purchases

Friend Aura offers in-app purchases, including:

• Boost Packs: Consumable purchases that add boosts to your account
• Pro Subscription: A recurring subscription that provides monthly boosts and premium features

5.2 Payment Processing

All purchases are processed through the Apple App Store. Apple's terms and conditions apply to all transactions. We do not process payments directly and have no access to your payment information.

5.3 Subscription Terms

For Pro subscriptions:

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You will be charged for renewal within 24 hours prior to the end of the current period
• You can manage or cancel your subscription in your Apple App Store account settings
• Canceling a subscription stops future charges but does not refund the current period
• If you cancel, you retain Pro features until the end of the current billing period

5.4 Refunds

All sales are final. Refund requests must be made through Apple, as they process all payments. We do not control Apple's refund policies.

5.5 Pricing Changes

We reserve the right to change subscription prices or boost pack pricing at any time. Price changes for existing subscribers will be communicated at least 30 days in advance and will take effect at the next renewal period.

6. Intellectual Property

6.1 Ownership

Friend Aura and all associated intellectual property rights belong to us. This includes:

• The App's code, design, and functionality
• The Friend Aura name, logo, and branding
• All themes, emoji packs, and visual assets
• The aura number generation system and algorithms

6.2 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use Friend Aura for your personal, non-commercial use, subject to these Terms.

6.3 Restrictions

You may not:

• Copy, modify, or create derivative works of the App
• Sell, rent, lease, or sublicense the App
• Remove or alter any copyright, trademark, or proprietary notices
• Use the App's branding or intellectual property without permission

7. Privacy

Your use of Friend Aura is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how we handle data.

8. Disclaimers and Limitations of Liability

8.1 "As Is" Provision

Friend Aura is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be error-free or uninterrupted
• Warranties regarding the accuracy, reliability, or completeness of the App

8.2 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers (if applicable)
• Any bugs, viruses, or malicious code transmitted through the App
• Any errors or omissions in the App's content
• Loss of data stored on your device or iCloud

8.3 Maximum Liability

In no event shall our total liability to you for all damages exceed the amount you paid us in the twelve (12) months prior to the action giving rise to liability, or $100, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless Friend Aura and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your content stored in the App

10. Modifications to the Service

We reserve the right to:

• Modify, suspend, or discontinue the App (or any part thereof) at any time
• Add, remove, or change features or functionality
• Update the App to fix bugs or improve performance

We will make reasonable efforts to notify users of significant changes, but we are not obligated to do so. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App.

11. Modifications to These Terms

We may update these Terms from time to time to reflect:

• Changes to the App or our business practices
• Legal or regulatory requirements
• Improvements to user clarity

If we make material changes, we will notify you through the App or via email (if available). Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms. The "Last Updated" date at the top of this page reflects when these Terms were last changed.

12. Termination

12.1 Termination by You

You may stop using Friend Aura at any time by:

• Uninstalling the App from your device
• Canceling any active subscriptions through the App Store
• Deleting your data from the App and iCloud (if applicable)

12.2 Termination by Us

We reserve the right to suspend or terminate your access to the App if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• We are required to do so by law

12.3 Effect of Termination

Upon termination:

• Your license to use the App terminates immediately
• You must cease all use of the App and delete it from your devices
• Any data stored locally or in iCloud remains your responsibility to delete
• Certain provisions of these Terms (disclaimers, limitations of liability, indemnification) survive termination

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law principles.

13.2 Dispute Resolution

13.3 Arbitration

If we cannot resolve a dispute informally, any legal dispute will be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

13.4 Class Action Waiver

You agree that disputes must be brought on an individual basis only, and not as a plaintiff or class member in any purported class or representative proceeding.

14. Apple-Specific Terms

Because Friend Aura is distributed through the Apple App Store, the following terms apply:

• Apple is not a party to these Terms and is not responsible for the App
• Apple has no obligation to provide support for the App
• In the event of any failure of the App to conform to any warranty, you may notify Apple for a refund of the purchase price (if any), and Apple will have no other warranty obligation
• Apple is not responsible for addressing any claims you or any third party may have relating to the App
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Friend Aura regarding the App.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

15.5 No Agency

No agency, partnership, joint venture, or employment relationship is created as a result of these Terms, and neither party has any authority to bind the other.
